Terms of Service

Welcome to Bayan. These Terms of Service ("Terms") are an agreement between you and Bayan ("Bayan," "we," "us," or "our") and govern your use of the Bayan mobile app and the website at bayanapp.ai (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Who can use Bayan

You must be at least 13 years old to use Bayan. If you're under the age of majority where you live, you should review these Terms with a parent or guardian. By using the Service, you confirm you can form a binding agreement with us.

2. Your account

You're responsible for keeping your login details secure and for activity that happens under your account. Please give us accurate information when you sign up, and let us know at bayanapp.ai@gmail.com if you think someone else has accessed your account. You can delete your account at any time from the app's Settings or by contacting us.

3. Subscriptions, billing, and cancellation

Bayan offers a free tier and an optional Premium subscription that unlocks features such as unlimited recordings and longer talks. Premium is offered as an auto-renewable subscription, currently in these plans:

• Monthly — billed every month;
• Annual — billed every year.

The exact price for your region is shown in the app at the time of purchase. Pricing may change; we'll always show the current price before you buy.

How billing works

• Payment is charged to your Apple ID account when you confirm the purchase.
• Your subscription automatically renews for the same period unless you turn off auto-renew at least 24 hours before the current period ends.
• Your Apple ID is charged for the renewal within 24 hours before the end of the current period, at the then-current price.
• You can manage or cancel your subscription any time in your device's Settings → Apple ID → Subscriptions. Cancelling stops the next renewal; it doesn't refund the current period.
• Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

Purchases and refunds are handled by Apple under the App Store terms. We don't process payments or store your card details. For refund requests, use Apple's Report a Problem page.

4. Your content

The recordings, transcripts, notes, reflections, and saved verses you create are yours. We don't claim ownership of them. To run the Service, you grant us a limited license to store, process, and transmit your content — including sending audio and transcripts to our AI processors — solely to provide Bayan's features to you (transcription, summaries, citations, and your library). This license ends when you delete the content or your account, except for copies that may remain temporarily in backups. See our Privacy Policy for the details.

5. Acceptable use

Please use Bayan respectfully and lawfully. You agree not to:

• Record people without the consent required where you are;
• Upload content that is unlawful, infringing, or that you don't have the right to record or share;
• Attempt to break, overload, reverse-engineer, or gain unauthorized access to the Service;
• Use the Service to harass others or to violate anyone's rights.

7. Our intellectual property

The Bayan app, website, name, logo, and design are owned by us and protected by law. These Terms don't give you any right to use our branding without our permission. The Quran and hadith referenced within the app are, of course, not owned by anyone — we simply help you find and save them.

8. Third-party services

Bayan relies on third-party services (for example, Apple, cloud hosting, and AI providers) to operate. Your use of those services may be subject to their own terms. We're not responsible for third-party services we don't control.

9. Termination

You can stop using Bayan and delete your account at any time. We may suspend or end your access if you violate these Terms or use the Service in a way that could harm Bayan or others. If we end your access, sections of these Terms that should reasonably survive (such as content licenses already used, disclaimers, and limitations of liability) will continue to apply.

10. Disclaimers

Bayan is provided "as is" and "as available." We work hard to keep it accurate and reliable, but we don't guarantee that transcripts or summaries will be error-free, that the Service will always be available, or that it will meet every need. To the fullest extent permitted by law, we disclaim warranties not expressly stated here.

11. Limitation of liability

To the fullest extent permitted by law, Bayan will not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Where liability can't be excluded, it is limited to the amount you paid us for the Service in the 12 months before the claim.

12. Apple App Store terms

If you download Bayan from the Apple App Store, these Terms are between you and Bayan, not Apple, and Apple is not responsible for the app or its content. Apple's standard Licensed Application End User License Agreement also applies to your use of the app. Apple is a third-party beneficiary of these Terms and may enforce them.

13. Changes

We may update these Terms or the Service over time. When we make material changes to these Terms, we'll update the "Last updated" date and, where appropriate, notify you in the app. Continuing to use Bayan after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the United States and the state in which Bayan operates, without regard to conflict-of-law rules. Some jurisdictions give you rights that can't be waived; nothing here is meant to limit those.
